Employment Law Update

Employment Legislation Update 2026 and Beyond.

The Employment Rights Bill is expected to become law before the end of 2025. This means important changes to employment law. A few changes are expected to happen when the Bill becomes law or soon after. Most changes will happen in 2026 and 2027. The Bill is currently going through parliament. It may have further changes added before becoming law. When it becomes law, the Bill will introduce additions and amendments to existing legislation, including the Employment Rights Act 1996.

We have now given you the full run down of what we know to date in terms of the planned changes over 2026 and 2027.

But why are knowing about these changes important?

1. Legal compliance and avoiding penalties

As we have shown over the last few weeks, Employment laws in the UK change regularly and if you don’t keep up, you could unintentionally break the law. This is initially likely to lead to unhappy employees who will submit complaints or greivances to air their concerns and if upheld you will need to make changes, on a more serious level, not keeping up can lead to tribunal cases, fine and enforcement action.

This can all be avoided if you keep up to date with the changes and implement them in your business in good time and communicate the changes out to those that need to know.

2. Protecting your business from disputes

If you have up-to-date knowledge it will help you keep your policies and procedures up to date. These are key to the successful management of your employees and to communicate your expectations of them allowing them to work compliantly.

Again keeping these documents up to date can reduce the risk of costly employee dispute or claims, even small mistakes can lead to expensive legal action.

3. Treating employees fairly and consistently

Understanding current laws ensures employees receive the correct pay and working hours, their statutory rights such as holiday entitlement and parental leave and protects them from unfair treatment such as discrimination.

Ensuring you, your management team and other employees understand this protection will build staff trust, which in return you get increased productivity and reduces turnover.

4. Supporting better management decisions

Knowing your legal responsibilities helps you make confident decisions about processes such as recruitment, probation periods, flexible working requests and disciplinary cases. This prevents making any risky decisions that might cause a claim later on.

This then protects your reputation as an employer and your brand. Staying compliant shows professionalism and responsibility which can attract new employees, retain existing staff and build trust with clients and suppliers.
